1. Who we are. MyStarsAI ("we," "us," "our") is a software-as-a-service business based in Grand Prairie, Texas, serving customers across all 50 United States. Our website is mystarsai.com. We help small businesses manage their online reputation through AI-powered automated review requests, AI-generated responses, and reputation monitoring.

2. Information we collect. We collect information you provide directly including your name, business name, email address, phone number, business type, and billing information. We also collect usage data, log data (IP address, browser type, pages visited), and data from third-party integrations you connect such as Square, Vagaro, or Google Business Profile.

3. How we use your information. We use your information to provide and improve MyStarsAI's services, send automated SMS review requests to your customers on your behalf, send service-related communications and account updates, process payments, respond to support requests, and comply with legal obligations. We do not sell your personal data to third parties.

4. SMS messaging. By providing your phone number and checking the SMS consent box, you consent to receive automated text messages from MyStarsAI. Standard message and data rates may apply. You may opt out at any time by replying STOP. For help reply HELP. Message frequency varies. MyStarsAI is not responsible for any charges incurred from receiving SMS messages.

5. Billing and payment data. MyStarsAI requires a valid credit or debit card to begin your free trial. Your card information is collected and stored securely by Stripe, Inc. MyStarsAI does not store your full card number. By entering your card you authorize MyStarsAI to charge your payment method beginning 30 days after your trial start date unless you cancel before that date. You will receive an email reminder 7 days before your trial ends. Stripe's privacy policy is available at stripe.com/privacy.

6. AI disclosure. MyStarsAI uses artificial intelligence to generate suggested review responses on your behalf. These are drafts for your review and approval. We use AI provided by third-party providers. Your business data may be processed by these providers solely to generate responses. We do not use your data to train third-party AI models.

7. Third-party services. MyStarsAI integrates with Square, Vagaro, Jobber, Toast, Fresha, Housecall Pro, Clover, Mindbody, Google Business Profile, Zapier, Stripe, and Twilio. When you connect these services data is shared with them under their respective privacy policies.

8. Data retention. We retain your data for as long as your account is active. You may request deletion by emailing hello@mystarsai.com. We will delete your data within 30 days except where required by law.

9. Your rights — all United States residents. Depending on your state you may have rights to access, correct, delete, and port your personal data. California residents have rights under CCPA/CPRA. Virginia, Colorado, Connecticut, Texas, Florida, and other state privacy law residents have rights under their applicable state laws. To exercise any rights email hello@mystarsai.com. We will respond within 45 days.

10. Security. We implement industry-standard security measures including encryption in transit and at rest. No method of internet transmission is 100% secure.

11. Children's privacy. MyStarsAI is not directed at children under 13. We do not knowingly collect information from children under 13.

12. Changes to this policy. We may update this Privacy Policy periodically. We will notify you of material changes by email or website notice.

1. Acceptance of terms. By creating an account or using MyStarsAI's services you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and MyStarsAI.

2. Description of service. MyStarsAI provides software tools for small businesses to manage online reputation including automated SMS review requests, AI-assisted review response drafting, review gate technology, and reputation analytics. We are not a law firm and do not provide legal advice.

3. Subscription and payment. MyStarsAI is a subscription service billed monthly. A valid credit or debit card is required to begin your free trial. Your card will not be charged during the 30-day free trial period. After 30 days your selected plan fee ($49, $99, or $199/month) will be automatically charged on a recurring monthly basis unless you cancel before the trial ends. You authorize MyStarsAI to store your payment method and charge it automatically each billing cycle. You will receive an email reminder 7 days before your first charge.

4. Free trial. New accounts receive a 30-day free trial. A credit or debit card is required at signup. You will not be charged during the trial. At the end of the trial your card on file is automatically billed for your selected plan. You may cancel any time before day 30 to avoid any charge.

5. Cancellation and refunds. You may cancel your subscription any time from your dashboard. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial months. Technical failures caused solely by MyStarsAI will be reviewed case-by-case.

6. Acceptable use. You agree to use MyStarsAI only for lawful purposes. You may not use MyStarsAI to send unsolicited messages to people who have not done business with you, create fake reviews, violate Google's review policies, violate the TCPA, harass or mislead any person, or violate any applicable law. You are solely responsible for obtaining all necessary consents from your customers to send them SMS messages.

7. TCPA compliance. You acknowledge that you are the sender of record for all text messages sent through MyStarsAI. You represent and warrant that you have obtained proper written consent from each customer before their phone number is added to MyStarsAI's system. MyStarsAI provides tools to help facilitate compliance but is not responsible for your compliance with TCPA or any applicable communications law.

8. Google review policy compliance. You agree not to use MyStarsAI to solicit fake, incentivized, or fraudulent reviews. You are responsible for ensuring your use of MyStarsAI complies with all applicable platform terms of service.

9. AI-generated content. You acknowledge that AI-generated content may require editing and that you are responsible for reviewing and approving all content before it is posted publicly. MyStarsAI makes no warranty that AI-generated responses are accurate, appropriate, or error-free.

10. Intellectual property. MyStarsAI and all associated software, designs, logos, and content are owned by MyStarsAI and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or distribute any part of MyStarsAI without written permission.

11. Disclaimer of warranties. MyStarsAI is provided "as is" without warranties of any kind. We do not warrant that the service will be uninterrupted or error-free.

12. Limitation of liability. To the maximum extent permitted by law MyStarsAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid to MyStarsAI in the 3 months preceding the claim.

13. Indemnification. You agree to indemnify and hold harmless MyStarsAI and its owner from any claims, damages, liabilities, and expenses arising from your use of the service or violation of these terms.

14. Governing law and jurisdiction. These Terms are governed by the laws of the United States and the State of Texas. For customers outside Texas disputes will be resolved in state or federal courts of Dallas County, Texas. Nothing in these Terms limits your rights under applicable federal law or the consumer protection laws of your home state.
